Breaking: High Court Issues Conditions For Gen. Tumukunde Bail Application Hearing Amidst Coronavirus Scare

The High Court Criminal Division has issued conditions for the hearing of the bail application filed by Lt. Gen. Henry Tumukunde, through his lawyers of Wameli  & Co. Advocates.

Gen. Tumukunde, who announced his bid to contest for presidency in 2020 was arrested on March 12, 2020, and later remanded to Luzira prisons on  March 18, 2020, over charges of treason and illegal possession of firearms, vide case file number HCT-00CR-CM-0052-2020 and HCT-00-CR-CM-0053-2020.

He was arrested together with 13 others who include the Tororo North County Member of Parliament Annet Nyakecho, although he denied the charges.

Gen. Tumukunde was charged with treason after he allegedly said during aa TV interview that if he was Rwanda or Kagame, he would join forces with everyone who wants to oust President Yoweri Museveni, utterances which, according to Police Spokesperson Patrick Onyango, tantamount to treason.

A notice written by Justice J. W. Kwesiga, the Head, High Court Criminal Division, served to the Director of Public Prosecutions and Tumukude’s lawyers of Wameli & Co. Advocates, state thus;

BEFORE ME: HON. MR. JUSTICE J.W. KWESIGA

TO ALL PARTIES

Following the prevailing threats pursuant to Government guidelines to prevent the dangers associated with avoidable public gatherings, the above Bail Application will not be conducted in open courts as follows;

  1. The Application shall be heard and disposed of through written submission of the Applicant’s and Respondent’s Advocates that will be filed as herebelow;
  2. The Applicant shall file written submissions with all his supporting documental evidence and serve the Respondent’s Advocates NOT LATER than 28th March 2020.

(b)The Respondent shall file the reply to Application, if any, NOT LATER than 3rd April 2020.

(c) The Applicant shall file a rejoinder, if any, NOT LATER than 6th April 202

2. Ruling of the court will be on 14th April 2020

3. It is hereby directed that all pre-trial proceedings be transferred from City Hall Court to the Chief Magistrate Court at Buganda Road with a view to managing those proceedings through Video-Linked System in line with these directions.
