The long-running legal dispute over the mental health of Kampala property mogul Mohan Musisi Kiwanuka has taken a dramatic twist after the High Court granted his relatives unrestricted access to him. This decision follows years of wrangling over Kiwanuka’s mental state, which has fueled family divisions and legal battles.

The ruling was delivered after an application by Kiwanuka’s sisters—Jalia Muwanga, Nantege Yudaya Nsereko, Berti Nsereko Kawooya, and Sarah Nsereko—who petitioned the court under Miscellaneous Cause No. 82 of 2023, seeking a formal determination of their brother’s mental condition. When the case came up for hearing on February 11, 2025, Kiwanuka’s lawyer, Francis Buwule, admitted that his client is indeed mentally ill. In response, Justice Flavian Zeija ordered that the sisters and other relatives be granted unfettered access to Kiwanuka, marking a significant shift in the ongoing legal battle.
A Family At War

The debate over Kiwanuka’s mental health began in 2019 when his eldest son, Jordan Sebuliba, challenged his father’s ability to manage his vast real estate empire. Relying on a 2017 certified medical report from a UK-based neurologist—which was requested by Kiwanuka’s wife, Maria Kiwanuka—Sebuliba argued that his father suffered from debilitating dementia, a condition that severely impacts memory and cognitive function.

This dispute escalated when Mohan ordered the eviction of Sebuliba, his siblings, and his mother from prime properties in Kololo and Nakasero. However, when the case reached the High Court, Justice Musa Sekaana ruled against ordering a mental examination, asserting—after a 30-minute interaction with Kiwanuka—that he was of sound mind and capable of managing his affairs.
Unconvinced, Sebuliba took the battle to the Court of Appeal in Civil Appeal No. 61 of 2020 and Civil Appeal No. 43 of 2020. But just as his appeals were awaiting hearing, a crucial admission changed the trajectory of the case.
In an unexpected development, during the hearing of the case brought by Kiwanuka’s sisters, his own lawyers admitted that he is insane. This admission has given Sebuliba fresh legal ammunition.
On February 12, 2025, Sebuliba, through his lawyers at BKA Advocates, wrote to the Court of Appeal registrar, citing the new High Court ruling as proof that Kiwanuka has been of unsound mind since 2017. He argues that any decisions made by his father after this period should be declared null and void.
“During the said hearing [in Miscellaneous Cause No. 82 of 2023], counsel for Mohan Kiwanuka admitted that he is insane. The purpose of this letter, therefore, is to pray that you be pleased to take judicial notice of this order and of this development,” reads part of the notice.
With the High Court ruling now on record, the next phase of the legal battle could see fresh claims over Kiwanuka’s estate and the legitimacy of business decisions made under his name. The Court of Appeal will now have to consider Sebuliba’s argument that his father was not mentally fit to make key financial and legal decisions.
As the legal drama unfolds, the Kiwanuka family remains deeply divided, with different factions vying for control over his empire.
