Cross-Border Justice at Risk As Uganda Law Society Pushes for Karua’s Certification

Kampala: Martha Karua, a senior Kenyan advocate and former Justice Minister, has become central to a legal debate regarding her ability to practice in Uganda. The matter began when she applied for a temporary practicing certificate to represent Dr. Kizza Besigye, a prominent opposition figure, and Hajji Obeid Lutale at the general court martial. However, the Law Council of Uganda denied her initial application on 6 December 2024, sparking concerns about cross-border legal practice and fairness in Uganda’s legal system.

Following this denial, Karua resubmitted her application on 23 December 2024. This time, her request was accompanied by a formal communication from the Uganda Law Society, which expressed grave concerns over the initial rejection and called for greater transparency and fairness in such decisions. In response, the Law Council announced a special meeting scheduled for 6 January 2025 to deliberate on the resubmitted application. If granted, Karua would be able to represent her clients in court the next day, potentially strengthening the defense team in this high-profile case.

In a statement signed by ULS president Isaac Ssemakadde, he urged the law council to use the opportunity to reexamine their decision and stamp their true independence by dispensing justice to such requests.

The court martial proceedings involving Dr. Kizza Besigye and Hajji Obeid Lutale have drawn significant attention, as they are often perceived as politically charged. Karua’s involvement underscores broader issues of legal transparency, the rights of international advocates, and the fight against political interference in judicial matters. This case continues to attract regional and international interest, with many viewing Karua’s advocacy as a symbol of justice and fair representation.
