Kampala: Mengo Court Chief Magistrate Esther Nansambu has dismissed with costs  Bobi Wine’s brother Fred Nyanzi Ssentamu’s petition seeking for recounting of votes from 50 Polling stations gazetted in Kampala Central constituency where Nyanzi Claimed had irregularities.

On Tuesday this week, Sentamu petitioned Mengo Magistrate’s Court seeking for recounting of votes in the disputed Kampala Central member of parliament race..

In her ruling, Nansambu noted that the court cannot proceed to order for a vote recount due to lack of evidence on the side of the applicant adding that Nyanzi did not notify the officer in charge of the elections in this case that he intended to file a petition against the results.

she further added that the declaration forms were all signed by the applicants’ agents at all the polling stations where Nyanzi alleges had irregularities.

Therefore court maintains that Muhhamad Nsereko is the legitimate member of parliament elect for Kampala Central.

Muhammad Nsereko was declared winner after garnering 16,998 votes as his closest opponent, Nyanzi polled 15,975 giving a difference of 1,022 votes. Nsereko is the only MP who won the election in Kampala with the rest being won by National Unity Platform (NUP).

Through his Lawyers led by Anthony Wameli, Nyanzi alleged that the electoral process was marred with malpractices and alterations of results. He told the Court that his client’s agents were threatened and chased away from polling stations.

Nyanzi contended the Electoral Commission connived with Nsereko to alter and manipulate results recorded on many of the Declaration of Results Forms.
