Wakiso: Lawyers representing hundreds of residents of Lusanja village who are set to be evicted from their land have been left in confusion after some of the evictees refused to be part of the appeal against the High Court ruling last week in
The lawyers who include Lord Mayor Elias Lukwago are confused about the next step after some of the Lusanja residents declared that they don’t want to be included on the list of those who want to appeal and pray for compensation from Kiconco.
Some of those who don’t want to appeal are Magezi Robert, Kanyike Fred, Nandala Richard, Kirabira John, Madina Nansereko, Scovia Nanyanzi among others.
On Wednesday October 9, 2019 they appeared before the high court registrar Flavia Nabakooza for guidance of how they can be scrapped off the appellants’ list.
According to them they are contented with what court decided; that the land belongs to Medard Kiconco legally and have further advised their colleagues who want to appeal to either go to President for help or else they will keep walking to court for their entire lives.
These people are the ones who, according to the judgement that was delivered last week by Justice Tadeo Asiimwe, are meant to be compensated by Kiconco.
Justice Asiimwe ruled that the land was bought by Kiconco in 2016 from the administrator Paul Katabazi Bitarabeho as opposed to the 148 other claimants who bought it from his sister Chrispa Bitarabeho, who had no right to sell the land.
Court also granted Kiconco permission to permanently vacate the tenants within a period of one month.
However, on Tuesday a group of people from Lusanja through their lawyer Lukwago, filed a notice of appeal at the high court, only to be shocked by their fellow evictees who have since asked to be deleted from the list of appellants.
